We find these very exciting, and when we have been excited quite enough, we curl up and go to sleep and Pooh, sitting wakeful a little longer on his chair by our pil low, thinks Grand Thoughts to himself about Nothing, until he, too, closes his eyes and nods his head, and follows us on tip- toe into the Forest. There, still, we have magic adventures, more wonderful than any I have told you about; but now, when we wake up in the morning, they are gone before we can catch hold of them. How did the last one begin? One day when Pooh was walk ing in the Forest, there were one hundred and seven cows on a gate No, you see, we have lost it. It was the best, I think. 《国家中长期科学和技术发展规划纲要(2006-2020年)》实施情况中期评估工作方案2006年国务院颁布实施的《国家中长期科学和技术发展规划纲要(2006-2020年)》(以下简称《科技规划纲要》)是新时期指导我国科学和技术发展的纲领性文件。当前纲要实施时间过半,为在新形势下深入推进创新驱动发展战略,确保2020年实现进入创新型国家行列的战略目标,经请示国务院同意,科技部拟会同相关部门组织开展《科技规划纲要》实施情况中期评估,特制定本方案。一、评估目的《科技规划纲要》颁布实施以来,我国科技事业快速发展,创新能力大幅提升,在稳增长、调结构、转方式、惠民生中发挥了重要的支撑引领作用,创新型国家建设取得积极进展。党的十八大明确提出实施创新驱动发展战略,全国科技创新大会和《中共中央 国务院关于深化科技体制改革加快国家创新体系建设的意见》对深化科技体制改革、加快国家创新体系建设作出重要部署,对我国科技发展提出了新的更高的要求。习近平总书记在中央政治局第九次集体学习时,对深入实施创新驱动发展战略作出重要指示,要求抓好顶层设计和任务落实。同时,国内外发展形势出现重大变化,特别是国际金融危机以来,全球科技和经济社会发展呈现新的态势,我国科技发展面临的形势和任务也出现了许多新的特点。本次评估的目的:一是全面掌握《科技规划纲要》实施情况,客观评价纲要实施以来我国自主创新能力的变化,及时发现纲要执行中存在的突出问题并分析原因;二是根据新的发展形势和需求,深入贯彻十八大关于创新驱动发展战略的战略部署,提出下一步推进纲要实施的对策,包括重大任务部署和重大政策措施的充实调整建议;三是通过开展评估,推动政府转变职能,加强宏观引导,凝聚社会共识,进一步推进科技体制改革和创新驱动发展战略实施。二、评估原则中期评估坚持以下原则:坚持客观公正。以事实和客观信息为依据,广泛收集各方意见,发扬民主,充分讨论,确保评估结论的客观公正。评估结论主要依托专家研究形成,相关部门负责为评估专家提供信息及必要支持。坚持需求导向。面向当前和未来我国科技发展的战略决策需求,紧密围绕《科技规划纲要》实施,对我国科技改革发展中遇到的科技与经济结合、科技高端人才培养、大力提升原始创新能力等重大问题进行分析评价,提出切实可行、具有可操作性的政策建议。坚持全球视野。充分考虑中国科技发展与世界的互动与融合,在全球科技与经济社会发展背景下对纲要实施和中国科技发展作出判断。积极拓展评估的国际视角,充分听取国外专家咨询意见,为评估结论形成提供重要参考。坚持广泛参与。广泛动员科技界、经济界、企业界、科研管理人员以及社会公众共同参与评估,充分听取全国人大、全国政协相关机构和各民主党派、全国工商联以及人民团体的意见,也要注意听取相关社会组织的意见。评估目的、评估专家、评估机构、评估发现和阶段性成果采用合适的方式公开公示,接受社会监督。三、评估范围与内容(一)评估范围。本次评估的范围是《科技规划纲要》及其配套政策自2006年颁布至今的实施进展情况及成效,评估节点截至2013年6月30日。评估活动按照全面评估、突出重点的思路,以纲要目标和任务部署为主线,对纲要整体实施情况进行全面调查评估,对战略目标的阶段性实现程度作出客观评价;重点关注国家科技重大专项、重点领域和配套政策的实施情况,对纲要实施以来我国自主创新能力的变化、科技支撑引领社会经济发展的效果、创新政策环境、形势变化与挑战等作出评价,并提出重大战略任务和重要政策措施调整充实的建议。(二)评估内容。评估内容包括7个部分,26个评估要点(详见表1):1.总体目标的实现程度。分析主要发展指标的进展情况,对纲要目标的实现程度进行评价,对创新型国家的建设进程作出客观判断,预测2020年最终目标的实现情况。2.国家科技重大专项实施进展与效果。对重大专项的任务部署和进展情况进行深入调查,客观评估重大专项实施在促进战略性新兴产业发展、探索社会主义市场经济条件下新型举国体制和项目管理机制等方面取得的成效。3.各领域科技任务实施进展与效果。深入调查基础研究、前沿技术、重点领域及其优先主题等方面的任务部署和实施进展,对我国科技创新能力变化、科技支撑引领经济发展方式转变和民生改善的成效等进行客观评价。4.配套政策实施与国家创新体系建设的进展与效果。深入调查科技体制改革及国家创新体系建设、科技投入与创新资源优化配置、科技基础条件平台、人才队伍建设、知识产权战略以及相关配套政策措施的落实情况,客观评价纲要实施以来我国创新环境发生的变化,对阻碍我国科技创新的体制机制问题进行识别分析。 5.纲要的组织实施机制。对纲要与国民经济社会发展规划的衔接,各地方、部门落实纲要的机制,纲要实施与科技资源配置的衔接机

人大主导立法调研报告党的十八届四中全会《决定》提出健全有立法权的人大主导立法工作的体制机制,发挥人大及其常委会在立法工作中的主导作用。习近平总书记指出加强人大对立法工作的组织协调,健全立法机关主导、社会各方有序参与立法的途径和方式,健全起草、论证、协调、审议机制,完善立法项目征集和论证制度。发挥人大在立法中的主导作用,是新形势下加强和改进人大立法工作的一个重要着力点,也是充分发挥立法引领和推动作用的必然要求。把人大主导立法工作写进党的重要文件,成为全党共同遵循的基本原则,这是对中国特色社会主义法治建设的重要贡献,也是党为人大立法工作指明了方向。近年来,xx市人大常委会认真贯彻和落实党的十八大和党的十八届三中、四中全会精神和习近平总书记系列讲话精神,并将其贯穿于立法工作的始终,坚持依法立法,坚持民主立法和科学立法,积极探索主导立法实践,取得了一定的工作成效。一、主导立法,就要在源头上把好立项关。法规立项是体现人大主导立法的关键所在,是立法决策的前提,决定着立法的价值取向和立法功能的有效发挥。在立法整个过程中,法规立项是立法工作的源头。立项工作是整个立法活动能否获得成功的至关重要的环节。目前,在人大立法工作中,无论是立法规划,还是年度立法计划安排,基本都是政府报什么,人大就立什么,始终处于等米下锅的被动工作局面。这既是多年立法工作的传统做法,也是立法工作的无奈之举。其原因:一是人代会获取立法的建议案有限,每年人代会上涉及立法的代表议案和建议少之又少,即使有那么一两件,不是缺乏立法条件,就是立法时机还不成熟;二是人大内部工作机构由于工作分工所致,加之年度工作较为繁忙,在精力上往往无暇顾及立法建议的提出;三是人大机关现有人员状况,不是编制缺乏,就是法学专业人才短缺,往往不能够提出有价值的立法建议;四是多年形成的所谓工作习惯,运作中已经驾轻就熟,工作也十分方便,不愿意也不情愿将其轻易的放弃。为了把好法规立项关,从源头上充分体现人大主导,主要做了以下几方面工作:一是坚持围绕中心。坚持将人大的立法工作始终至于党的领导之下,立法规划和年度立法计划向党委汇报,及时将党委意图转变为人大的立法决策。工作中主动作为,探索立法工作新机制,创新立法工作新方法,充分发挥立法的引领和推动作用。二是突出工作重心。围绕全市工作大局,紧贴工作重点,及时将成熟性的政策、行之有效的做法、相对稳定的行政规范,社会普遍关注的难点热点等转变为地方立法的重要选项。三是坚持点菜上桌。在广泛征集立法建议的基础上,严格立法项目建议提出程序规范,反复研究,权衡论证,认真筛选,切实把好选项关,确保把具有立法必要性和可行性、调整范围和主要内容明确、人大代表和社会公众关切、经济社会发展迫切需要的立法项目列入立法规划和立法计划。2013年按照市委要求,迅速启动制定《xx市促进民营经济发展条例》和修订《xx市优化投资环境条例》。这两项立法项目都是围绕党委中心工作,临时追加的立法项目,且在人大立法史上创造了专门成立立法协调小组、专门增开一次常委会等,充分彰显人大主导立法工作的多个第一,顺利完成了立法任务,市委给予充分肯定,同时也产生了广泛的社会影响。二、主导立法,就要把握立法过程的主导权。人大主导立法,是人大立法工作的实践总结,是落实依法治国方略的实际需要。人大把握立法工作的主导权,更是发挥人大立法主导作用的关键所在。立法工作实践表明,人大主导立法,就是要站在立法一线,就是要敢于直面问题,敢于在矛盾的焦点上砍一刀。现实中,有的地方人大往往在立项、审议、修改等环节不擅于行使法律赋予的职权,过分迁就部门利益,采取和稀泥,回避矛盾的做法,这样不仅难以主导立法,立法质量也难以保证。对此,我们主要从以下环节入手:一是超前谋划,提前介入。就是在立法项目确定之后,人大相关工作机构,对于工作安排、前期调研、参与起草、论证分析等工作环节要全程参与,掌握工作动态和信息,增强工作的主动性和时效性,加大工作力度和深度,及时了解并共同研究法规涉及的重要问题和关键制度,与相关部门绑在一起干,加强立法调研统筹协调,合理拟定调研工作方案,避免重复性调研,提高工作实效。二是注重邀请专家参与立法活动。立法是一项系统工程,是一项纯粹的技术性工作,随着社会分工越来越细化和明确,任何一个机关、一个组织、一个人都不可能做到事事通,样样行。因此,邀请专家参与法规起草并参加立法全过程,既是立法机关主导、社会各方有序参与立法途径和方式的重要体现,也是坚持科学立法、民主立法原则的实际需要。同时,以科学、公正、务实的态度参与立法活动,更能在法制统一性原则把关、厘清立责与立权关系等方面发挥重要作用。近几年来,xx人大法制工作机构与政府法制部门共商立法事项,先后邀请安徽大学法学院专家团队,参与了《xx市水资源保护条例
